Divorce & judicial Separation in India are subject to various legislations and choosing the right remedy depends upon the religion of the parties or upon the legislation pursuant to which the marriage of the parties took place.  Divorce laws have been broadly classified on the basis of religion of the parties with an exception under the Special Marriage Act (generally used in case of an inter-religion marriage). For example, below are some of the legislations governing marriages in India:

• Hindu Marriage Act, 1955 
• Special Marriage Act, 1954
• Foreign Marriage Act, 1969
• Parsi Marriage and Divorce Act, 1936
• The Indian Christian Marriage Act, 1872

Non-Resident Indians residing in some foreign jurisdictions may be able to legally dissolve their marriages in accordance with the laws of the country where they may be residing and seek enforcement of the foreign decree of divorce in India. However, at times, NRIs may choose to dissolve their marriage in India for various reasons. 

The Hon’ble Supreme Court of India in Y. Narasimha Rao and Ors. V/s Y. Venkata Lakshmi and Ors. held that the jurisdiction assumed by the foreign court as well as the ground on which the relief is granted must be in accordance with the matrimonial law under which the parties are married. The major roadblock faced by NRIs in dissolution of their marriages in India is the possibility of travelling back and forth for the legal process. However, the use of a Power of Attorney eliminates this problem and makes it easier for NRIs to dissolve their marriages in India. The increasing use of technology by the courts and adoption of Video-conferencing (VC) as an alternative to physical mode of appearance has made it possible to record statements of parties through VC and our team has the requisite experience in conducting such proceedings.

In a troubled marriage, the most important issue that troubles the parties is the custody of the child. The end of the marriage always deprive the child from the love of one of the party. For years, the mother was considered to the right person to be handed over with the custodian of the child however there seems to be a slight deviation from this principle as every custody varies in terms of facts. 

The current principle of the law is the ‘welfare of the child’ as enshrined under Section 13 of the Hindu Minority and Guardianship Act, 1956 titled ‘Welfare of minor to be paramount consideration’. Courts while granting custody of the child (whether a boy/girl) courts generally tends towards choosing the alternative that will make the upbringing of the child most fruitful. This involves considering the love and affection, quality of education provided to child and overall development of the child. 

With the advancing times we tend to see that parties to a custody battle often tend to opt for the joint-custody of the child keeping in mind the welfare of the child. This helps the parents to avoid unnecessary lengthy litigations. It is advisable that the parties agree to common settlement terms whereby the parties individually get a fixed number of days or months. During these days, they can have the sole custody of the child with almost negligible involvement of the other party. We help our clients prepare the terms of the custody to be presented before the court. 

The courts in India are increasing awarding visitation rights to a non-custodial parent to allow sufficient access to the child, and to restrict the custodian parent from insulating/isolating the child from the non custodial parent.    

We help clients navigate the complexities of child support and alimony (spousal support) determinations, ensuring that financial obligations are calculated accurately and fairly based on each party's financial circumstances .

The Protection of Women from Domestic Violence Act (“Act”) is a beneficial legislation which is in the nature of a single-window mechanism to cater to a plethora of needs of women who are victims of domestic violence. Domestic violence is a pervasive and serious problem that affects individuals of all backgrounds, genders, and ages. It encompasses various forms of abuse, including physical, emotional, sexual, and economic abuse, and can have devastating consequences for survivors and their families.

The Act also contains provisions empowering courts to order a wide variety of reliefs (Protection order, shared household, residence order, monetary relief, custody, compensation orders). We, at LawCircle, assist our clients to secure favourable orders from the courts.
